The Denver Department of Excise and Licenses is committed to educating Denver landlords so they are in compliance with residential rental licensing regulations. This is a reminder that under Denver Revised Municipal Code (DRMC) 27-201 and Colorado Revised Statutes (CRS) 13-40-104, landlords must provide written notice of tenants’ rights and resources document, both at the time of executing a required written lease and any time the owner or operator makes a rent demand. This includes when a tenant signs a new lease or renews an existing lease.
Failure to provide this document is a violation of Denver law. There are penalties for noncompliance, so landlords should determine how to comply and be able to show proof of compliance if needed. These penalties include:
- Notice of violation
- First citation with a fine of $150
- Second citation with a fine of $500
- Third and subsequent citations with a fine of $999
The Denver Department of Housing Stability (HOST) updated the tenants’ rights and resources document. earlier this year. The documents in English and Spanish have been posted to our website and can be downloaded to provide to tenants.
There is also a “Renter’s Housing Handbook: A Guide for Denver Landlords and Tenants.” This guide summarizes the rights and obligations of residential landlords and tenants. It does not constitute legal advice and is intended to serve only as a general guide. Versions in English and Spanish are posted on our website.
